  1. This document contains MacHTTP's Terms and Conditions of Use, followed by
  2. the MacHTTP single user software license. Individuals or organizations
  3. interested in obtaining site licenses should follow the directions in the
  4. "Ordering Info" file. The "Ordering Info" file also contains information for
  5. ALL MacHTTP users on how to register MacHTTP.

  12. MacHTTP Terms and Conditions of Use
  13.  
  14. 1. Distribution of MacHTTP. MacHTTP Software, documentation, data, and
  15. license agreement are distributed by the Author in an archive or floppy
  16. disk (the archive) comprising the complete MacHTTP distribution. You are
  17. authorized to redistribute this unmodified archive for evaluation
  18. purposes only. Extracting the MacHTTP Software and/or data from the
  19. archive constitute acceptance of the license agreement.

  21. 2. Evaluation of MacHTTP. You are granted a period of 30 days from the
  22. receipt of the MacHTTP Software and data to evaluate MacHTTP. During this
  23. time, you may use the MacHTTP software to establish a World Wide Web
  24. service. During the evaluation period, you may not use the MacHTTP
  25. software to distribute information via the World Wide Web for profit or
  26. gain. At the end of the 30 day evaluation period, you must agree to the
  27. MacHTTP License Agreement and purchase the MacHTTP Software license from the
  28. author, or destroy all copies of MacHTTP Software and data.
  29.  
  30. 3. Use of MacHTTP Software. Use of the Software is covered by the terms
  31. within the license agreement. Portions of the Software that are
  32. copyrighted by Apple Computer, Inc., including but not limited to
  33. AppleScript runtime support software, are for use with MacHTTP Software
  34. and data only, and may not be copied or used separately.
  35.  
  36. 4. Individual, Educational, Commercial, and Government User License
  37. Costs. MacHTTP Software, documentation, and data must be licensed from
  38. the Author or an authorized representative of the Author. Federal, state,
  39. and local government entities, commercial organizations, educational
  40. institutions, and individuals may license MacHTTP Software and data at
  41. the rates specified in the "Ordering Info" file. This rate schedule
  42. includes any organizations that intend to use MacHTTP for activities that
  43. generate a profit from the direct or indirect use of MacHTTP to serve
  44. information on an internal corporate, government, or educational network
  45. or via public networks such as the Internet.
  46.  
  47. For the purposes of this rate schedule, the term “Internal Use” is
  48. defined as applying MacHTTP Software and data to implement a WWW server
  49. for use strictly by employees or authorized agents of a government,
  50. commercial, or educational organization on a network or portion of a
  51. network accessed only by employees and authorized agents of the
  52. organization. Internal Use excludes access by the general public by the
  53. Internet or other public access network computer systems.
  54.  
  55. The term “Public Use” is defined as applying MacHTTP Software and data to
  56. implement a WWW server that is available to the general public via the
  57. Internet or other public access network computer systems. A Public Use
  58. server is classified as “not for profit” if the information is freely
  59. available to the general public and the services provided by the server
  60. are not directly supporting the sales or marketing of a commercial
  61. product or service, or generating direct revenue from the operation of
  62. the server. A Public User server is classified as “for profit” if the
  63. server provides access to information to paying customers, is operated by
  64. an organization that receives profit from the operation of the server, or
  65. is used in the sales or marketing of a commercial product or service.

  67. Private individuals who are using MacHTTP Software and data to implement
  68. a Not for Profit Public Use Server may obtain a no-cost license from the
  69. Author, provided their use of the MacHTTP Software is unrelated to their
  70. duties as an employee or agent of a government, commercial, or
  71. educational organization and that MacHTTP is not installed on computer
  72. hardware belonging to a government, commercial, or educational
  73. organization or computer hardware that is physically located at one of
  74. these organizations. All other uses of MacHTTP Software by private
  75. individuals will be treated as Commercial applications of the MacHTTP
  76. Software.

  78. A Single User license allows the user to install and use MacHTTP Software
  79. and data on one computer. A Site License allows an unlimited number of
  80. copies to be installed by an organization on the organization’s computer
  81. systems within a 15 mile radius of a specified location.

  83. 5. Support and Upgrades. All support for MacHTTP will be provided via
  84. electronic mail or U.S. Mail with the Author, or the MacHTTP Home Page 
  85. on the World Wide Web.
  86.  
  87. This license will entitle the registered owner of  MacHTTP Software to 
  88. obtain free updates to MacHTTP Software for a period not less than
  89. 1 year from the date the license is assigned. This update period may be 
  90. extended on a yearly basis after the initial period has expired for an
  91. annual support fee not to exceed 20% of the original license fee per year.

  98. PLEASE READ THIS LICENSE CAREFULLY BEFORE INSTALLING OR USING THE MACHTTP
  99. SOFTWARE.  BY DOWNLOADING, INSTALLING, AND/OR USING THE SOFTWARE, YOU ARE
  100. AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE.  IF YOU DO NOT AGREE
  101. TO THE TERMS OF THIS LICENSE, YOU ARE NOT AUTHORIZED TO DOWNLOAD,
  102. INSTALL, AND/OR USE THIS SOFTWARE.

  104. 1. License.  The MacHTTP application, demonstration, system, and other
  105. software accompanying this License, whether on disk, in read only memory,
  106. or on any other media or networked storage device (the "MacHTTP
  107. Software"), the related documentation and data (the “data”) are licensed
  108. to you by Charles T. Shotton, Jr. (the “Author”). You own the disk on
  109. which the MacHTTP Software and data are recorded but the Author and/or
  110. the Author’s Licensor(s) retain title to the MacHTTP Software, related
  111. documentation and data. This License allows you to install and use the
  112. MacHTTP Software and data on a single computer and make one copy of the
  113. MacHTTP Software and data in machine-readable form for backup purposes
  114. only.  You must reproduce on such copy the Author’s copyright notice and
  115. any other proprietary legends that were on the original copy of the
  116. MacHTTP Software and data. You may also transfer all your license rights
  117. in the MacHTTP Software and data, the backup copy of the MacHTTP Software
  118. and data, the related documentation and a copy of this License to another
  119. party, provided the other party reads and agrees to accept the terms and
  120. conditions of this License.

  122. 2. Restrictions.  The MacHTTP Software and data contains copyrighted
  123. material, trade secrets and other proprietary material and in order to
  124. protect them you may not decompile, reverse engineer, disassemble or
  125. otherwise reduce the MacHTTP Software to a human-perceivable form.  You
  126. may not modify, network, rent, lease, loan, distribute or create
  127. derivative works based upon the MacHTTP Software in whole or in part. 
  128. You may not electronically transmit the licensed MacHTTP Software from
  129. one computer to another or over a network.
  130.  
  131. 3. Termination.  This License is effective until terminated.  You may
  132. terminate this License at any time by destroying the MacHTTP Software,
  133. related documentation and data and all copies thereof.  This License will
  134. terminate immediately without notice from the Author if you fail to
  135. comply with any provision of this License.  Upon termination you must
  136. destroy the MacHTTP Software, related documentation and data and all
  137. copies thereof.

  139. 4. Export Law Assurances.  You agree and certify that neither the MacHTTP
  140. Software nor any other technical data received from the Author, nor the
  141. direct product thereof, will be exported outside the United States except
  142. as authorized and as permitted by the laws and regulations of the United
  143. States. If the MacHTTP Software has been rightfully obtained by you
  144. outside of the United States, you agree that you will not re-export the
  145. MacHTTP Software nor any other technical data received from the Author,
  146. nor the direct product thereof, except as permitted by the laws and
  147. regulations of the United States and the laws and regulations of the
  148. jurisdiction in which you obtained the MacHTTP Software.
  149.  
  150. 5. Government End Users.  If you are acquiring the MacHTTP Software and
  151. data on behalf of any unit or agency of the United States Government, the
  152. following provisions apply.  The Government agrees:
  153.  
  154. (i) if the MacHTTP Software and data are supplied to the Department of
  155. Defense (DoD), the MacHTTP Software and data are classified as
  156. "Commercial Computer Software" and the Government is acquiring only
  157. "restricted rights" in the MacHTTP Software, its documentation and data
  158. as that term is defined in Clause 252.227-7013(c)(1) of the DFARS; and
  159.  
  160. (ii) if the MacHTTP Software and data are supplied to any unit or agency
  161. of t United States Government other than DoD, the Government's rights in
  162. the MacHTTP Software, its documentation and data will be as defined in
  163. Clause 52.227-19(c)(2) of the FAR or, in the case of NASA, in Clause
  164. 18-52.227-86(d) of the NASA Supplement to the FAR.
  165.  
  166. 6. Disclaimer of Warranty on MacHTTP Software.  You expressly acknowledge
  167. and agree that use of the MacHTTP Software and data is at your sole risk
  168. The MacHTTP Software, related documentation and data are provided AS IS
  169. and without warranty of any kind and the Author and the Author's
  170. Licensor(s) (for the purposes of provisions 6 and 7, the Author and the
  171. Author's Licensor(s) shall be collectively referred to as "the Author")
  172. EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT
  173. LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
  174. PARTICULAR PURPOSE.  THE AUTHOR DOES NOT WARRANT THAT THE FUNCTIONS
  175. CONTAINED IN THE MACHTTP SOFTWARE WILL MEET YOUR REQUIREMENTS,OR THAT THE
  176. OPERATION OF THE MACHTTP SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR
  177. THAT DEFECTS IN THE MACHTTP SOFTWARE AND THE DATA WILL BE CORRECTED. 
  178. FURTHERMORE, THE AUTHOR DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS
  179. REGARDING THE USE OR THE RESULTS OF THE USE OF THE MACHTTP SOFTWARE AND
  180. DATA OR RELATED DOCUMENTATION IN TERMS OF THEIR CORRECTNESS, ACCURACY,
  181. RELIABILITY, OR OTHERWISE.  NO ORAL OR WRITTEN INFORMATION OR ADVICE
  182. GIVEN BY THE AUTHOR OR A REPRESENTATIVE AUTHORIZED BY THE AUTHOR SHALL
  183. CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY. 
  184. SHOULD THE MACHTTP SOFTWARE PROVE DEFECTIVE, YOU (AND NOT THE AUTHOR OR A
  185. REPRESENTATIVE AUTHORIZED BY THE AUTHOR) ASSUME THE ENTIRE COST OF ALL
  186. NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT
  187. ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT
  188. APPLY TO YOU.

  190. 7. Limitation of Liability.  UNDER NO CIRCUMSTANCES INCLUDING NEGLIGENCE,
  191. SHALL THE AUTHOR BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL
  192. DAMAGES THAT RESULT FROM THE USE OR INABILITY TO USE THE MACHTTP SOFTWARE
  193. OR RELATED DOCUMENTATION AND DATA, EVEN IF THE AUTHOR OR AN AUTHORIZED
  194. REPRESENTATIVE OF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  195. DAMAGES.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF
  196. LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION
  197. OR EXCLUSION MAY NOT APPLY TO YOU. In no event shall The Author’s total
  198. liability to you for all damages, losses, and causes of action (whether
  199. in contract, tort (including negligence) or otherwise) exceed the amount
  200. paid by you for the MacHTTP Software and data.

  202. 8. Controlling Law and Severability.  This License shall be governed by
  203. and construed in accordance with the laws of the United States and the
  204. State of Texas, as applied to agreements entered into and to be performed
  205. entirely within Texas between Texas residents.  If for any reason a court
  206. of competent jurisdiction finds any provision of this License, or portion
  207. thereof, to be unenforceable, that provision of the License shall be
  208. enforced to the maximum extent permissible so as to effect the intent of
  209. the parties, and the remainder of this License shall continue in full
  210. force and effect.

  212. 9. Complete Agreement.  This License constitutes the entire agreement
  213. between the parties with respect to the use of the MacHTTP Software,
  214. related documentation and data, and supersedes all prior or
  215. contemporaneous understandings or agreements, written or oral, regarding
  216. such subject matter. No amendment to or modification of this License will
  217. be binding unless in writing and signed by the Author or a duly
  218. authorized representative of the Author.
